215. To ask the Minister for Education and Skills if she will urgently review the situation whereby teachers who were initially on the pre-2013 pension (legacy scheme) and were forced to temporarily leave service are now being left on the post-2013 pension, despite joining their profession prior to this; and if she will make a statement on the matter. The Single Scheme applies to persons who start pensionable public service jobs on or after 1 January 2013.
The conditions providing for membership of the Single Public Service Pension Scheme are set out in primary legislation namely at Section 10 of the Public Service Pensions (Single Scheme & Other Provisions) Act 2012.
An exemption from Single Scheme membership applies in cases where a public servant previously held membership of a pre-existing public service pension scheme and did not subsequently have a break in service of more than 26 weeks as a public servant. The legislation does not provide exemptions based on the reason an individual had for ceasing the employment while a legacy scheme member.
As previously advised, If there is further information regarding the employment records of the individual on whose behalf the initial enquiry was made, which has not come to our attention then the Pensions Unit will review her case on receipt of same.
