Question 113: To ask the Minister for Health and Children the number of compliance tests carried out on retail premises by the Office of Tobacco Control; the number of prosecutions initiated against retail premises for the sale of tobacco to persons aged under 18 in respect of each county for the past two years for which figures are available; and if she will make a statement on the matter. The Deputy's question relates to the enforcement of tobacco control legislation. The enforcement of the prohibition on the sale of tobacco products to persons under 18 years of age is the responsibility of the environmental health service of the Health Service Executive. Accordingly, my Department has requested the Parliamentary Affairs Division of the Executive to arrange to have this matter investigated and to have a reply issued directly to the Deputy.
