323. To ask the Minister for Agriculture, Food and the Marine if he will confirm that it is essential for an animal welfare charity to have a dog-breeding establishment licence in order to access the annual grant funding (details supplied). [4955/23]

With effect from 1stFebruary 2020, sellers and suppliers of pets animals, including animal welfare charities, that sell or supply six or more pet animals in a calendar year (and are not registered as a Dog Breeding Establishment) must comply with the requirements of SI. No 681 of 2019 - Animal Health and Welfare (Sale or supply of Pet Animals) Regulations 2019.
This a legal requirement independent of the Animal Welfare Grant programme.
In the context of any such entities seeking support through the Animal Welfare Grants Programme, this legal requirement is clearly outlined in the Terms and Conditions of the Programme issued at the outset of the application process.
The organisation referred to was not compliant with this criterion when the applications were being assessed and was not considered for funding under the Programme.
