200. To ask the Minister for Jobs, Enterprise and Innovation the status of the Workplace Relations Commission in preparing a code of practice under section 42 of the Industrial Relations Act 1990 to set out best industrial relations practice in managing the engagement between employers and employees in the run up to retirement, including requests to work beyond the normal retirement age in the employment concerned; the way and with whom the commission has consulted in preparing this code of practice; if a deadline has been set by when she expects the commission to complete its work; and if she will make a statement on the matter. The Workplace Relations Commission (WRC) is an independent, statutory body established on 1st October 2015 under the Workplace Relations Act 2015.
In accordance with the provisions of Section 42 of the Industrial Relations Act, 1990, I have requested the WRC to prepare a Code of Practice around the issue of longer working lives. The Code of Practice is to set out best industrial relations practice in managing the engagement between employers and employees in the run up to retirement, including requests to work beyond what would be considered the normal retirement age in the employment concerned. As is standard practice for this process, the WRC is consulting with relevant stakeholders for their views, including employer representatives, Trade Unions and Public Sector. It is anticipated that a draft Code will be submitted to me shortly.
