Question 411: To ask the Minister for Justice, Equality and Law Reform if quarry blasting permits are issued when the courts are examining the legal status regarding the requirement for planning permission for quarries which have applied for blasting permits. [4507/05]

The Garda authorities have advised me that the Garda SÃochána does not issue blasting permits where a local authority has refused planning permission to carry out such activity, or where an enforcement order under the Planning Acts to prevent such activity as blasting exists.
The granting of blasting permits is a responsibility for the superintendent of the Garda district in which the blasting occurs and I have no statutory function in the matter.
